Was just about to start playing ME2, but when I started a new game, I noticed that it was the wrong save file not my last save, instead it used my first playtrough when I killed the counsil. Not like the last, when I rescued them. How do I get it to use my last save file? I hope it can be fixed or else it sucks.

You should have multiple saves with the same name if you used the same character to beat the game multiple times. Try to pick the right one, it might help if you remember the order you beat it in and remove the other files, because in-game, you have to go through a few minutes of cutscenes if you picked the wrong one as there is no "Back" button that I know of until you gain control of your character.

Use the load game function and select the correct save file, not resume which loads the file with the most recent save, this includes autosaves, which are generated at the end of set pieces.
