I noticed that no medi-gel is lost when you give one to the sick Batarian in the quarantine area of Omega. The option to give one away is a paragon interrupt, and for it to actually qualify as a paragon deed a medi-gel would have to be lost, IMO. Also, it shouldn't be possible if you're out of medi-gel.
Just putting it out there if the devs want to fix it in a patch.

It would brake the game should someone be unable to do the paragon choice because he has no medi-gel IMO, but you do have a point. I also expected this to drain medi-gel when used, but was suprised it didnt.
It is probaly meant to work this way though to avoid what i stated earlier, to be unable to preform the paragon choice.

why would it break the game if you're unable to give medi-gel? it could then have the option to say "sorry I've got no medi-gel for you" and maybe get less paragon points for that.
