The definition is extremely wide so almost anything could fit in it, not just AU stuff.

I was talking about the definition used by the US Supreme Court. Most AU stuff wouldn't qualify either.

OK, what I've found on Wikipedia is as follows:

The modern emphasis of transformativeness in fair use analysis stems from a 1990 article by Judge Pierre N. Leval in the Harvard Law Review, Toward a Fair Use Standard,[1] which the Supreme Court quoted and cited extensively in its Campbell opinion. In his article, Judge Leval explained the social importance of transformative use of another's work and what justifies such a taking:

I believe the answer to the question of justification turns primarily on whether, and to what extent, the challenged use is transformative. The use must be productive and [1] must employ the quoted matter in a different manner or for a different purpose from the original. ...[2] [If] the secondary use adds value to the original--if the quoted matter is used as raw material, transformed in the creation of new information, new aesthetics, new insights and understandings--this is the very type of activity that the fair use doctrine intends to protect for the enrichment of society.

Transformative uses may include criticizing the quoted work, exposing the character of the original author, proving a fact, or summarizing an idea argued in the original in order to defend or rebut it. They also may include parody, symbolism, aesthetic declarations, and [3] innumerable other uses.





OK, I'd argue that FF based on a game is using the material in a different manner. Arguably I think it could also meet the second condition. I'd still say it can be bloody wide...

So out of curiosity...

FF.Net didn't always have stats. Lots of people here seemed concerned with them (or at least comment every time they are not working).

What would you guys do if stats (not reviews) were removed or never came back, in the sense that would their absence have an impact on your productivity uploading/updating stories?

I know some people delay their chapters and wait for when stats are functioning. If it was announced they were gone for good, would you then just get on with the story or stop writing (for FF.Net/entirely)?

I'm insecure enough that I need stats to continue a story, if not to start it. If I'm slogging through a story and no one is reading, I don't have any reason not to just dump the story and move on to the next random idea that pops up. ;p

This is why my novel-size story is postponed and my one-shots are thriving. One-shots don't need stats on their side.

If I was told that stats were gone forever, I would adjust my expectations accordingly. But it's having stats and then suddenly nothing --with no official acknowledgment from ff.net that stats aren't working-- that makes it frustrating.

If the stats weren't there I really wouldn't care (rhyme tyme!). But since they are there I become like Abe "Grandpa" Simpson: "I don't need it. I don't want. But if they miss one payment, I'll raise hell!"

I like seeing the numbers but it wouldn't stop me from writing if they weren't there. It's not going to happen though. Gish what a depressing idea for some. Tsk. :)

It took me a while to even find out there WAS a stats feature on FF.net :P I'd already written close to 100,000 words by then. If they disappeared, I would not be overly phased.

That said, fifth day of them being down. I stand by my impression that this is better than not being able to post anything new because of errors.

Lo and behold, FF.net is working again. Now let's hope the posting error does not show up again, yes?

FF.net was borked again and all the stats were down!
The sighing and the crying was heard through all the town
We hit refresh so often that the F5 got all worn
We thought we'd move to AO3 and FF.net we'd scorn...

@SoLD: I'm not on FF.net, but I do appreciate some sort of feedback - "likes" on my BSN home page, comments on my blog, or stats on my pages here at BSN.  If I got nothing at all, I'd eventually feel like I was shouting into the Void and go back to writing Anglo-Saxon poetry and filthy fabliaux instead - those I *know* will have an eventual audience when I perform them!

I don't live by my stats, but every once in a while, particularly when a chapter doesn't get much feedback, I like to glance at them just to reassure myself that people are still reading.

Frankly, I get more feedback over on DreamWidth than I do at ff.net. Without the stats, I'd have no idea that my readership is something like 200 people for Elysium (that's the number of unique visitors that view each chapter) rather than a couple dozen.

With the posting process at ff.net being so convoluted and needlessly complex, without the stats, I'd have no reason to continue using ff.net. I'd probably stop posting there and concentrate on AO3 and DW.

Hmm, I must be mad. I think I'm making another 18K-word chapter, 70% of which is epic-level battle versus a particularly wretched Pride Demon (and then some).

I admit to needing and loving the stats, I'm not paid, I sink a lot of time and effort into my FF stats are the thing that keep me going.

okay i don't have a fanficton account because well i don't exactly write my work. its more of the drawn variety (i hope you don't mind an artist coming here and ranting but it is a comic I'm working on so i figure i can talk here *sage nod*) i do have my DA account. i don't mind seeing my page view up and seeing when things get faved and what not however if they don't happen i'm cool with that also. i enjoy painting and ultimately that's the reason i do it. i have a blog which i have like 5 watchers for and barely get any comments and i still post there because its so fiun and another place to share my art even if its not seen much. i'm also on a couple of other art forums. which i get some feedback on how to improve. gotta love feedback for that. i figure the more places it is the more its likely to get seen the more its likely to get a review or 2 so even though a lot of them don't have stats and such. i think remembering why you do something is important. i paint because i love it. i cant not paint. sure i have days where no one looks at my art what's the point but i always pick myself in the end but most of the time i'm cool with just painting for paintings sake :)

on another note i've actually started panneling for my comic :D and also at a point where i can happily say i'm doing my comic digitally because i'm getting used to it and it will keep material costs down. though i was really sad the otherday about some work i did for it (not going to get into details) which kinda killed my mood for that page. luckily its later on in the story so i should be able to pick it up okay by then.

*edit* some mistakes corrected.  sorry i'm bad at writing.

While the stats keep me posting to ffnet specifically, they don't really keep me writing. It's more that because I know my stuff gets a thousand hits a day there I'm willing to tolerate what a pain in the ass the site is.

Given the choice, I prefer feedback on ffnet in the form of reviews, being added to people's favs, and followed over just plain stats.

The stats are verrry slowly backdating, I've noticed: First they started showing up for today, then for yesterday, and I just got a "new" hit from Saturday. :D

We're all different especially when it comes to motivation, favouriting is fine but it's a one-off I just likely the daily flow of stats.
