It would probably stay under the radar and go unchallenged as long as it wasn't mass produced and profited from. Otherwise the permission to use the likeness of the characters of the EA/BioWare's intellectual property would have to be granted first.
Contestable. Software and music companies have already experienced success in various countries contesting people's right to make copies of software and music. In many places you are still allowed to make a single back-up copy although you may not tinker with the safety measures or IP material in any way in order to make a copy. Besides, making a copy implies you have already bought the item in question, which in this instance is a shirt or hoodie. Making a back-up copy would be somewhat redundant at that point and regardless would only be allowed once per original item (so if you wanted to make a print of it for three friends two of them would be disappointed).
