I did it like this, if you do the IFF last, talk to Legion twice in a row..
When you wake him up and talk to him, finish the conversation and talk to him again. He gives you the loyalty. I have been doing this since first playthrough.

Well I loaded right before waking up Legion after IFF mission. This time I DID NOT talk to him when Kelly tells you about his loyalty mission request. I ran around doing all kinds of planet scan missions, tali's loyalty mission, ran around checking that I bought all the armor and weapon upgrades and couldn't get the cut-scene to start.
After talking to legion about loyalty crap, did his mission, then next time I touched the galaxy map the cut-scene started.
Basically, don't talk to legion after he wants to talk to you and you should be ok.
Recently, I did a playthrough where I got Legion as soon as possible, having done none of the loyalty missions and still needing to recruit Tali. In this case, I did quite a few missions before EDI said the IFF was almost ready. I had also hadn't talked to Legion about his loyalty mission because I was intent on not doing any of them for this particular playthrough.
So what triggers the crew kidnapping is either based on the number of missions you've done or possibly what level your character is.
The common denominator is still that you didn't talk to Legion about his loyalty mission. How long after getting him that early until it triggered the availability of the loyalty mission?

It wasn't immediate. I think I probably did three missions before Kelly told me he wanted to talk to me. I probably should have kept track of it better.

Well I just did the IFF then turned on Legion, did samara's loyalty mission, then Kelly told me about legions loyalty. Still not talking to legion after that I ran around doing DLC and scan missions and... GOT NABBED! I wasn't expecting it at all, so that throws my answer about not getting his loyalty mission out the window. I did gain a couple levels though, somewhere around 22 or 23. I reloaded before it anyhow.
