I think The Code is very non-implicit in stating how a Justicar should behave personally. The 5000 sutra's probably focus on all the different situations that one could encounter, but don't really get into things like "one should not lick their fingers after eating...". So Justicars probably extrapolate how they should behave and Samara is probably more on the conservative side on this regard.

Given that Casey Hudson stated they intended ME3 to be playable as a stand-alone game, it's quite possible that a romance with Samara would take the whole game to develop. Which it would, even for an imported ME2 character (in which case it could be the second chance we're hoping for if the writers get it right).
I kind of expect Shepard will kinda have to "win back" his/her ME1 LI even if he/she "remained faithful" in ME2. A few "import specific" lines would allude to events in ME2. The same can be said of your ME2 LI, who may demand that Shepard "make a choice".

I thought so, but wanted to make sure. It sounded pretty interesting though, and something that I would look into if in fact is was in the Wiki or codex for example.
