Oghren has not been officially stated to be the returning character so no one has any idea what would happen if he is dead in your save because we don't even know if he's the returning companion.

Even if your other companions don't die, most of them leave Ferelden at the end, or are otherwise indisposed. Oghren is not only the least likely to die, but he's also got the most stable ending - no matter what, he's still just kind of chilling out in Ferelden at the end.
He's also the most popular of the non-romanceable companions. Bringing one romanceable companion back and not the others would open up a whole new can of worms among the Alistair, Morrigan, Leliana, Zevran fanboys and fangirls. And so bringing back the favorite non-romance companion makes sense.
While it would be cool to be able to choose which companion to bring, its just not feasible from a development standpoint. You would have to write new lines, bring back voice actors, and design new content for all of the original companions, and yet only have one that the player actually uses. It is simply not worth it. And so the devs probably chose to go with the companion that makes the most sense given the story. And all signs point to Oghren.

For all the people wondering: It's possible to use console commands to set Oghren's approval to -100, then select an option that says {Kill him] which will result in Oghren suddenly disappearing without a death animation of any kind. At the end of the game Oghren still gets a paragraph explaining what he did after the Archdemon was defeated just as if he was alive.
My guess would be that at one point the developers were going to allow Oghren to be a killable character, so had the option in there, but ended up not pursuing it because of talks of how they should develope Awakening. Soo... they merely set the negative approval needed to perform this act to an impossible amount, likely so they could easily set it back to a reasonable number if they changed their mind. This fits with the option not having an animation or leading to any changes in Oghren's story.

Seriously, shut up. You sound like an absolute moron when you **** about relatively trivial things. If you don't like Oghren, then DON'T USE HIM. Romances ARE NOT GAME BREAKING IN ANY WAY. Whining about minor mechanics/RP and a single freaking party member is quite shallow. If you let those keep you from experiencing an otherwise remarkable story, then you have awfully skewed priorities.

How do you kill him? I made an entire character for the purpose of trying to kill him and got him to -100 approval and he never attacks me or anything. When I tell him to leave he just says he hopes the archdemon chokes on me and leaves.

You have to go to Orzammar first. Pick him up first (waste of time) but then through out the game you have to do things he disagrees with and when he ever talks to you be rude to him and then next thing you know hes at -100.
