A conspiritorial investigation plot element would make an interesting twist for Mass Effect 3, I think.
To be honest. I'll think the whole "Shepard declared rouge" should have been used in ME2. ME3 needs to conclude the reaper plot after all, and spending too much time playing cops and robbers in citidal space will distract from that.
That is of course saying, they couldn't tie that into the main plot of the Reapers "finding another way". And Shepard very nearly did get declared rogue by the Council, and he/she is still disassociated from them at best.
