I doubt that they are going to take them as different characters. They were different before Virmire, after it, writers just consider them as the same character, just because one of them have to live/die.

It's not a problem limited to you.

While I think I'd get a response a lot faster if I just sent a PM to a Bioware mod, I tried to address the issue "properly" by starting a thread about it on the appropriate forum. So if you're having this problem, mention it here and we'll see if something comes of it.

Hmm that would be odd, seeing how many could have died in ME2... so one way or the other, they need a new set of chars as well, I think. Anyway, it would be really bad form not to add the ME1 LI's to 3, in my book. 

And if I can choose 10, apart from Kaidan, Mordin would be on that list, with Garrus and Tali. That means there are about 6 spots still to fill.
