Now that I've played that scene again the How you've been comes off better because it could be my imagination or someone having suggesting this on the forum before, but Shep does seem uncomfortable when saying it, like she's not sure what to say and how he's going to react, and then it's totally inadequate and blows up in her face. If I think about it pretty sure I've said and done something similar before..I hope I'm not trying to excuse BioWare, I do wish they'd written the encounter differently, but I do see that particular line in a new light now, and it gives Shepard a human flaw.
I've pretty much come to terms with Horizon by now; as I figure, Kate never really got around to put her mind into having been dead - sure, people say it, but throughout both Mass Effect 1 and 2 there's this general impression that she's the sort who deals with the present, "the mission", first and leaves sorting out loss/grief/emotional woes for later. In fact, with Joker, Chakwas and Garrus all around, I think to a point she was falling back into old motions and could almost pretend to herself she never died for two years and the rest of the team are just temporarily away somewhere.
Of course, Kaidan proves her wrong, but hey. Also, of course, it might just be because I have the scene of Kate looking at his picture in retrospect; I loved that scene.

One in particular really annoys me - on the quest to recruit Samara where you come across the asari eclipse merc (Elnora?) - you've already been told that they kill someone to earn their uniform, yet the paragon option is to let her go after swallowing her lamearse story about just pretending to shoot. Hell, shep may be a nice person but she's not a gullible fool.

I really do think he's just jealous of your Shepard's stache. He's probably thinking that if he had chops like that, he'd have fine ladies like Ashley and Liara fighting over him too.
