No, she is only imprisoned because the authorities on Illium want to prevent a situation in which she kills an alien. She is free to leave Illium (as she does with Shep in the end), but not free to investigate the Eclipse base further.
If she wouldn't follow the code, but simply investigating further with the oath not to kill anyone or simply ask the police for help and wait the necessary time in the cell, while the police would find out, where the Eclipse took Morinth, she could reach her goal, but due to the code she is not flexibly enough to act like that.
IIRC the cop states that she has been asked to take Samara in to custody, not just restrain her for 24 hours (that was a clever use of laws by the cop to try and avoid an outright confrontation). If she leaves Illium that means losing the trail and waiting for who knows how long before maybe finding the trail again (and how many people will be killed by Morinth in the mean time?).
I find your notion of Samara being able to rely on the local Illium authorities naive in light of the corruption that we are told about by both local citizens and the cop on Illium. What you are proposing amounts to asking the fox to guard the hen house. Corrupt officials using their official power to protect criminal activities of mercenaries are all the more reason for Samara not to give in to their machinations, and flexibility on the matter in this case would result in her getting zero evidence from the Eclipse mercenaries (see the merc that is offered the chance to live if she tells Samara the name of the ship).
