I agree. The link had a clear warning on it and yet they chose to click it.
That makes about as much sense as putting soap on your eyes that has a warning asking you not to do that, and then trying to sue to company of said soap.
Wouldn't surprise me if that happened. Think of that time someone burned themselves with McDonalds coffee and tried to sue them for it being too hot.

That's why we need inane obvious warnings on things. Clearly even that isn't always enough 
While I will be the first to defend the importance of nuances, multi-faceted aspects and two-way-street application of laws and such for both the innocent and the guilty, etc. in situations such as the one you are referring to I am reminded of a bumper sticker I saw on a college dorm door when I was an undergraduate freshman. It read, "Stupidity should be painful." Sometimes it's hard for me not to agree, even though I tend to feel some amount of sympathy for the feelings of the offending party.
