But the discs are much more succeptible to scratches when it's on its side (vertical). The only reason you might have to do that is overheating issues, which can easily be fixed by putting it on a hard flat surface (horizontally). No it isn´t, a XBox without that hardware issue will not scratch any discs.
There´s not one fact that would support your statement, except people not bein careful and hittin their console why playin.

You do realize the if you download a game to your 360 Hard-drive and run your game from there the Disc will not acutally be made to spin except to verify that it's *in* the machine, i.e. confirm that you own the game. So, as long as you have the space to keep your game on a harddrive, putting you 360 in a Verticle position does not matter and is in fact more beneficial to the machne's heat control as it allows all ventalation sources to be unabstructed.
