If this toy company is making money off this gun and they don't have permission from Bioware or EA, that's pretty much theft of intellectual property.

Smells like copyright infringement unless BioWare/EA gave them the explicit right to make those....if they didn't then it sounds like an epic lawsuit to me.....I mean the punks are trying to sell those things.

Why are people so keen on sueing? Are lawsuits some kind of spectator sport over in the US?

Hey, I defy every stereotype! I could take or leave tea, have great teeth and my manners are awful! Also, I don't wear a top hat, or even a bowler hat for that matter.

It's probably got enough minor differences to avoid a lawsuit. There are plenty of nerf-style and generic "light and sound" blasters in the aisles of Toys R Us that look almost exactly like Halo or Gears of War weapons that it's clear it doesn't take much differentiation to avoid a copyright infringement.

In fact, I'm betting it'd only be copyright infringement if the company was marketing this as the "M-8 Avengers Marshmallow Launcher."

Further still, the M-8 Avenger very well may not be copyrighted by Bioware/EA.

As for why it's not being sold yet? The picture comes from Toy Fair, I assume, which was just a couple weeks ago, and generally is showcasing items that won't come out until later in the year.
