I started a new game with my ME2 save, and consequently hit the level cap early on.  So now when I get to the Miranda/Jack argument and Legion/Tali argument, the paragon option is grayed out even though i've gotten as much paragon pts. as i could possibly find

Yup.  It's a bug.  There aren't any plans to fix it though.

O joy, good thing i spent 20+ hours on this playthrough trying to get the achievement for no one dying

This is why New Game+ sucks. I just import my old ME1 characters again when I want another playthrough.

Im on my first New Game+ and got to the Miranda/Jack one earlier I managed to get the paragon option with no problems, so I expect I'll have issue's with the Tali/Legion one. Does anyone know what causes it specifically or is it random?

It's not based on what level the character is, it's based on how early in the game the paragon/renegade option comes up and what percentage of possible paragon/renegade points you have out of the total possible at that point in the game. So earlier in the game means less points needed.

NG+ was not planned. Then fans cried it into the game. Now we have a NG+, crappy as any fan service.

What does the level cap have to do with anything? I've done NG+ twice and never had any problem.

Alright, just got Miranda's loyalty back, after finishing the game, and talking to everyone on the ship for a few extra paragon points, so yeah, you just need many more points
