Shepard is a marine, in the military. In our modern-day military, we have the don't-ask-don't-tell policy. It works because it gives patriotic homosexuals the opportunity to serve their country and protect their fellow citizens. On the other hand, the vast majority of the military does not approve of homosexuality, and the don't-ask-don't-tell policy keeps it at a comfortable distance. It is a compromise, and no compromise is ever perfect, but it works.
I have no idea what the military's perception of homosexuality is in the year 2185, but they seem to use many of the customs and courtesies of the current-day United States militaries, primarily a cross between the USN and the USMC. It is not inconcevable that the same or a similar policy exists.
Plus, to put it bluntly, homosexuals bother a lot of people, and that inhibits the cameraderie and instant trust that is required between people for whom killing other people before they kill you is your job. Not to mention the people who do not approve of the practice in real life. Shepard being a homosexual would be something they put in to satisfy a vocal minority, and while I would still buy Mass Effect 3, it would feel forced, and would put some people off the game.

I think it has been mentioned previously on one of these threads that the USA has one of the only modern militaries that still bans gays. While I hav a great deal of respect for the men and women who protect our freedoms and way of life here and abroad, it's a bit arrogant to think that in the far future, the USMC or USN will be the model of military protocol, or that prejudices, which would have to take a beating to accommodate different species and cultural practices as a result of an expanded universe, would still fixate on people of different sexual orientations when there would likely be so much else to hate on. Just like they've lifted the ban on women in battle, and, recently, women serving on submarines, DADT will go the way of the dodo, likely sooner rather than later, and I suspect with little loss of that killing spirit and elusive sense of het comaraderie. Let's hope BW, a Canadian company headquartered in a country that does not discriminate against gays, can envision a future not modeled after the military of the USA.

For one it's not like Shepard would be going around telling everyone he's gay. I mean... gay people don't act like that, especially in a professional environment. We're just like everyone else. But is a gay man Shepard came across an interested fellow gay soldier, then what's the problem?
I remember with my gay Fem!Shep Kaiden comes pretty close to outright asking if she's a lesbian. It's not like there wouldn't be subtleties.
And god I would hope in 175 years gays would have more acceptance than they do today.
Not to mention the Alliance Military isn't AMERICA, it's the entire Earth.
