It is possible that if you got him killed that he doesn't show up (one of my plays was with this save game From ME1 where I got his butt killed). He was never on Illium, could never talk to the chick selling weapons and never got my discount.
For that reason I vote coding error, either based on the fact that what was supposed to be there was held out (for reasons like not working properly) or just being a glitch. I actually vote that they had to take out the paragon choice do to time constraints. Hopefully DLC will fix this.

Lots of people have tried that logic, but he also says "you were a real jerk!" If you listen to his diagloue you'll notice he takes pauses right before the "jerk" and "and then you shoved a gun in my face" lines. Which usually means there are a couple different lines that could be played there and the game is figureing out which one.
Hell, I have very little writeing experince I could come up with dialouge that would replace only those two lines and turn it into the paragon version.

If it's in the ME1 save file: no. There's not really any good solution to it, other than having Miranda ask you if you stuck a gun in his face during the shuttle ride, or patching ME1 so it records the choice properly.
Other Intimidate/Charmed someone flags works fine.
Because those aren't f*cked up in the importable file.
The fact that they didn't make a paragon encounter means it's not a bug, that they just decided to go that way with it
No it means they realized it was bugged, and then went with it.
If however the Paragon email thing is true, which I've heard about, then it seem likely the bug is in the ME2 import utility and the game gives precedence to the Renegade flag for whatever reason. I've talked about the email thing myself, and I heard about it from a poster who claimed to have found it in the game files, but so far that's the only time someone has claimed direct knowledge. Everyone else is just saying "Well, I heard..." At this point, I think it's probably bunk. It seems odd no one else has discovered it, and equally odd that no one, including the person I got it from, has ever posted the text of the email.

That's not quite true, though it's not really any less the lamer for it. For instance, the game assumes the "Concentrate on Sovereign" option for the Council choice, not the "Screw the damn aliens" one, and Wrex dying isn't really a renegade thing either. That's just what happens by default if your Charm/Intimidate aren't high enough. Even saving him by doing the Family Armor quest is counted as Paragon by the game, as evidenced by getting the same point bonus you would from using Charm. Not sure how many others are technically neutral, though.
