... actually, I will be glad if he does. Pulling a trigger on him would make my Shepard uncomfortable. Killing the smartest man you ever met? Not my idea of good time.

I'd have a huge problem with TIM getting away scot-free, as it basically would be taking all the agency out of the hands of the player, which is a terrible idea for an rpg which sells itself on 'decisions.' Frankly, TIM is portrayed in such a manner as to leave me with the impression that he's very much the darling of the writing team, and when the writing team wants to focus on someone besides the main character in a game like ME I don't want to play it anymore.

Had plot hole #7 not been there by just allowing Shepard and company to walk out two plot holes could have been easily avoided.
This, I hate this so much considering none of her abilities work on enemies with sheilds

I always assumed he had direct control over it. Yes, once you get rid of the mercs in the hideout, it unlocks, but Garrus's dialogue made it clear, at least to me, that he recognized you at some point when you were coming over the bridge, especially since the only thing he does to you is knock down your shields if you stand around.
As for why it's open during the middle of the mission- well what I could say, that's the part that doesn't make as much since, but it can be explained away as things were just too involved at the moment for him to lock it back or he didn't want to lock Shepard out.
