From the wiki:
The divide between naval personnel and ground forces ("marines") is small. Ground units are a specialized branch of the fleet, just as fighter squadrons are. This unity of command is imposed by the futility of fighting without control of orbit; without the navy, any army is pointless. The marines, as a matter of pride, maintain some of their traditional rank titles; for example, marines have Privates and Corporals instead of Servicemen.
Seeing as Shep is usually fighting on ground, I think it would be safe to classify him as a Marine. However, in the Mass Effect series, the Marines are a part of the Navy. So he's both.
They do not use the same military structure as us, so it's a bit futile to try to force that on it.
At least that's what I gathered from reading the wiki.

Yeah... Like Ash did. You know, I always wondered how in hell Shepard got to command a ship when he's just a marine. I guess suspension of disbelief comes in here guys. He's a Marine and Navy. And he's a SPECTRE. What I don't get is, how come Captain Anderson has the same number of bars on his uniform as Rear Admiral Michailavich? Sorry about the spelling there.
As for Shepard not being promoted after the Battle of the Citadel--he was no longer a soldier in the Alliance Military once he became a Spectre, so he couldn't have been promoted. If he still had been with the Alliance, and gotten a promotion, he would have gone from Lieutenant Commander to Staff Commander, so he still would have been "Commander Shepard."

Probably also has to do with the fact that Shepard died within a month of saving the Citadel. Ashley (or Kaidan!!!) was promoted in the two years between the ME2 intro and "waking up"
