Because for Shepard, it hasn't really been 2 years? It has for you, as the player, but the whole SR1 explodey thing should feel like yesterday.
It's really only cheating if you expect to go back to your ME1 LI, but sleep with someone else in ME2, anyway. Otherwise it's just moving on.

Agreed! Especially after what happens on Horizon or seeing Liara's obsession and lies.

To be fair, it is implied that a fair amount of time passes between your first tryst before Ilos and the destruction of the Normandy. You've been out on patrol for quite a while, and probably got some R&R time on the Citadel before leaving. So... we're probably talking about quite a bit more than a one-night stand.
Still, after the way that Ashley & Kaiden react when you meet them on Horizon, I don't see any problems with moving on. To Hell with them. With Liara, it's a bit trickier... particularly if you figure out that she was the one who found your body, but I personally got the impression that Liara would actually encourage Shep to move on (at least for a while) until she gets the Shadow Broker monkey off her back. So, no. I don't really see any need for a big, nasty set of consequences for a second affair. Maybe a short confrontation scene to clear the air, but other than that, nothing.
Personally, as long as Kelly keeps her mouth shut, I'm golden.

My prediction, for what it's worth: the "consequences" will be an email, and the squadmate thing will be irrelevant since none of the ME1/ME2 squaddies will return (with the possible exception of Liara).
Even if I'm wrong about the squadmates not coming back, romance has never been related to the missions in the past -- you can have a nasty breakup with someone and still take them along on the next mission with no alteration in dialogue or anything else -- and I highly doubt BioWare will change that in ME3.

It isn't.
But...the consequences should be limited. I mean, Shepard is grievously insulted and then abandoned with a half-hearted apology through...EMAIL!? Lame!
I think that at worst you should have to choose, and even if you choose against the ME1 LI that person should take it like, 'well, I deserved that.'
