Importing assets from other games is a big "no-no" as it is a violation of the intellectual property rights of the makers of the other game. My guess is that you would no be allowed to distribute mods with such stolen content here on this site.

That said, there are going to be all kinds of mods that Bioware may not approve of. Nude mods for one (not that i care about the nudity, but the people who do those tend to make the body meshes much better, and then armor mods support them).  I hope that someone picks up that slack the way the Elder Scrolls Nexus does. People have modded other games' textures and such before for Oblivion, and I have never heard of that being a big issue.

Grabbing a texture or something from another game for a not-for-profit mod might be fair use, like quoting a paragraph from a book or using a magazine photo in a collage. I kind of have a good feel for this from helping my girlfriend determine what is fair use for the classes that she teaches. You can copy a whole book chapter, a poem or song, things like that.

Examples of things you could do just fine would be to use a leather texture from another game's armor set in some armor you were making or have a character say a bit of Tolkein's poetry. What not to do is modify a whole bunch of stuff from LOTR Online and recreate a Middle Earth village.

Indeed.  If you used a 3D tool to make a mdel from scratch there should generally not be any legal issues - you should be able to re-export it for any other game.

Having said that, there might be technical issues - the rigging might be incompatible, or the bump maps and so on, so some additional work might be required.

There are some things where even that hits legal bumps, but most other game developers are "okay" with it.

That said, beware LucasArts and lightsabers in particular. Also, don't import Fable 1/2 weapons, it just sticks out. Also be very careful about taking assets from NWN and NWN2, since you can very easily get an C&D warning just for that.

Otherwise, I do not believe Blizzard or Nintendo has any property of pursuit from recreating fan-made weaponry.

Just do not steal, is all and make them unique in your own way (different emblems on Master Sword, different colors for blade and hilt)

I am sure that people will be working on importing assets from NWN and NWN2.  I am fairly certain this is all open source/freeware.

There are a TON of high quality models that can be used from there.
