If you start the story over, With a character u just recently beat it with who is of higher lvl. And you play it on insanity with that same character can you still get the achievment?

Yes. But mind you, the game (up until Horizon) is much more difficult due to the fact that all enemies are scaled to your level and your lack of upgrades.

I second this, as I think everyone who has played ME2 Insanity will too. For ME2 Insanity you're much better off starting a brand new career, either at level 1 or even better with a ME1 import that bumps you up to level 3-5.
